Terms of Service

These Terms of Service ("Terms") govern your use of the YardScan platform, operated by Yard Scan Pty. Ltd. (ABN: 26 702 032 040) trading as YardScan ("YardScan", "we", "us"). By creating an account or using the platform, you agree to these Terms.

1. The Service

YardScan provides a subscription-based platform that allows car dealerships to generate and manage QR codes linked to vehicle listings, capture buyer leads, and view scan analytics.

2. Eligibility

You must be at least 18 years old and operate a legitimate business to use YardScan. By signing up, you represent that the information you provide is accurate and that you have authority to bind any business entity you represent.

3. Subscriptions and Billing

  • Subscriptions are billed monthly in advance. Prices are listed on the Pricing page.
  • Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your nominated payment method on a recurring basis.
  • Subscriptions automatically renew each billing period unless cancelled before the renewal date.
  • You may cancel at any time via the billing portal. Cancellation takes effect at the end of the current billing period — no refunds are issued for partial periods.
  • We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

4. QR Code Limits

Each subscription plan includes a maximum number of active QR codes as described on the Pricing page. You may not exceed the QR code limit for your plan. Upgrading your plan immediately increases your limit.

5. Lead Data

Lead data (buyer names, phone numbers, and email addresses) is collected through the public QR scan page and made available to the dealership whose QR code was scanned. You agree to:

  • Use lead data only for legitimate sales follow-up related to the vehicle the buyer expressed interest in.
  • Comply with all applicable laws when contacting leads, including the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
  • Not on-sell, share, or use lead data for any purpose unrelated to your dealership's operations.

6. Acceptable Use

You must not use YardScan to:

  • Violate any applicable law or regulation.
  • Generate QR codes that link to harmful, illegal, or misleading content.
  • Attempt to gain unauthorised access to the platform or other users' accounts.
  • Interfere with the operation of the platform or its infrastructure.

We reserve the right to suspend or terminate accounts that breach these rules.

7. Intellectual Property

All platform software, design, and content is owned by YardScan. You retain ownership of your dealership data and lead information. By using the platform you grant YardScan a limited licence to store and process your data solely to provide the service.

8. Service Availability

We aim to keep the platform available at all times but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party service failures, or circumstances outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, YardScan's total liability to you for any claim arising out of or related to these Terms or the platform is limited to the amount you paid us in the three months preceding the claim.

We are not liable for any indirect, incidental, or consequential loss, including lost profits or lost data.

Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

11. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or if we cease to offer the service. On termination, your access to the platform and your data will cease within 30 days, after which data may be permanently deleted.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
